Mediante uma revisão da literatura científica acerca da formação de juízos de
valor associados à tomada de decisão em processos judiciais, foi possível
identificar diversos aspectos que parecem interferir no veredicto do juiz em
situações de crime doloso, entre as quais as características faciais dos
elementos envolvidos. Assim, o presente estudo visa averiguar se as
características sociais inferidas a partir das faces - mais propriamente o grau
percebido de confiabilidade e de atractividade da vítima, assim como o grau
percebido de atractividade e agressividade do agressor - exercem influência no
modo como avaliamos a credibilidade do depoimento da vítima, por um lado, e
por outro lado, a culpabilidade do agressor, em situações de crime sexual e
não sexual. Para o efeito, foram apresentados aos participantes dois tipos de
crimes, com respectivo depoimento da vítima. Foi-lhes depois pedido que
visualizassem diversas caras de potenciais vítimas e potenciais agressores,
previamente seleccionadas de acordo com o seu grau de atractividade,
confiabilidade e agressividade, e que respondessem, para cada uma delas, a
algumas questões relacionadas com a credibilidade do depoimento da vítima e
a culpabilidade do agressor. A amostra foi composta por 64 estudantes
universitários. Os resultados obtidos apontam para uma influência positiva da
atractividade e negativa da agressividade na avaliação dos intervenientes em
situações criminais. Estes resultados levantam questões pertinentes relativas
aos processos de julgamento e à possibilidade de se tomar uma decisão
apenas baseada na avaliação dos factos e isenta de enviesamentos. Through a review of scientific literature about judgments associated with
decision making in legal contexts, it was possible to identify several aspects
that seem to interfere with the verdict of the judge in cases of intentional crime,
including the facial features of the elements involved. Thus, this study aims to
investigate whether social characteristics inferred from the faces - more
specifically the degree of perceived trustworthiness and attractiveness of the
victim, and the degree of perceived attractiveness and aggressiveness of the
aggressor – influence the way we evaluate the credibility of the victims’
testimony and the culpability of the aggressor, in situations of sexual and
nonsexual crime. To this end, participants were presented two types of crimes,
with the testimony of the victim in each case. After, participants were asked to
visualize various faces of potential victims and potential aggressors, previously
selected according to their level of attractiveness, trustworthiness and
aggressiveness, and to respond, in relation to each of them, to a number of
questions related to the credibility of the victim’ testimony and the culpability of
the aggressor. The sample was composed by 64 students. The results
obtained indicate a positive influence of attractiveness and a negative influence
of aggressiveness on the evaluation of the persons involved in criminal
situations. These findings raise important questions regarding the trial process
and the possibility of making a decision just based on the evaluation of facts
