A Entidade Reguladora para a Comunicação Social (ERC) é o organismo responsável pela
regulação dos meios de comunicação social em Portugal e foi criada em 2005 por lei da Assembleia da
República, sendo a única entidade reguladora com abrigo constitucional. O presente relatório insere-se no
quadro do estágio no projecto de investigação “A Regulação para os Media em Portugal: O Caso da ERC”
(PTDC/CCI-COM/104634/2008) e visa procurar compreender – e ajudar a compreender – a ERC. Por
conseguinte, o trabalho desenvolvido tem por base três dimensões: uma perspectiva histórica, uma
perspectiva conceptual e uma perspectiva performativa.
Em primeiro lugar, tecemos algumas considerações sobre os fundamentos da (hetero)regulação,
de forma a percebermos que valores e princípios estão associados a ela, nomeadamente os imperativos
de interesse público, de diversidade de acesso e conteúdo aos media e de garantia dos direitos dos
cidadãos. Além disso, procuramos perscrutar diferentes entendimentos acerca do tema. É neste contexto
que encontramos a perspectiva descentrada de regulação proposta por Julia Black (2002) e, num pólo
contrário, uma lógica de comando e controlo, com base em argumentos de que a regulação é um
mecanismo de supervisão e controlo utilizado pelo Estado face ao desempenho dos actores exteriores ao
mesmo, de que é exemplo a teoria de Abramson (2001).
Procuramos, de seguida, discorrer sobre cada uma das dimensões mencionadas em capítulos
distintos adoptando uma lógica transversal: uma abordagem teórica e de enquadramento inicial, a
exposição de opções relativas ao método científico utilizado e a apresentação de alguns resultados daí
decorrentes. Como tal, para melhor compreendermos a vertente histórica da ERC, no Capítulo II,
elaborámos uma linha cronológica da actividade da ERC (2005-2010), que nos permitiu agrupar em
categorias algumas das iniciativas e preocupações do regulador. A perspectiva conceptual diz respeito ao
modelo concebido para a ERC em sede política, que procurámos clarificar com recurso à apresentação
do organograma da entidade bem como ao exercício comparativo com outros organismos reguladores de
outros países. Por fim, desconstruímos a dimensão performativa da ERC através do método de
observação participante, que nos permitiu captar a actuação e as dinâmicas informais no seio da
entidade, decorrentes da coordenação das várias unidades especializadas que a compõem. The state media regulatory entity responsible for regulating the media in Portugal is called
Entidade Reguladora para a Comunicação Social (ERC) and was created in 2005 by law of the Assembly
of the Republic, being unique in terms of constitutional protection since it is the only regulatory body
figured in the Portuguese Constitution. This work is developed under the framework of an internship in the
research project “Media Regulation in Portugal: the ERC’s case” (PTDC/CCI-COM/104634/2008) and
aims to be a grounded contribution in pursuing its primary goal: to understand – and help understanding
– the ERC. As such, efforts where undertaken on a threefold basis related to a historical, conceptual and
performative dimension.
First, we draw some considerations on the fundamentals of (hetero)regulation so that we are able
to understand which values and principles are usually related to it, namely the requirements of public
interest, of media diversity in terms of access and content, and of ensuring citizens’ rights. We also try to
look for different understandings of regulation itself. In this context, we find Julia Black’s theory (2002) of
a decentered understanding of regulation and, in an opposite pole, a command and control perspective
(generally referred to as CAC) according to which regulation is an oversight mechanism used by state in
order to control non-state actors, standing for this Abramson’s thoughts (2001).
Following this, we develop each of the aforementioned dimensions in separate chapters
according to similar patterns: a prior theoretical approach, some considerations on the scientific method,
and the presentation of the correspondent ensuing results.
Thus, with the purpose of understanding the historical dimension of ERC, carried out in Chapter
II, we prepared a timeline of ERC’s activity during the period 2005-2010. This allowed us to subsume into
categories some of the major initiatives and worries expressed by this regulatory organism. The
conceptual dimension considers the politically designed model conceived for the ERC, having our work
consisted of the presentation and description of the ERC’s organizational chart as well as of the
comparative exercise with other national regulatory bodies across the world. Lastly, our contributions for a
better understanding of the performative dimension of the ERC derived from participant observation.
Using this method, we were able to track not only ERC’s daily activity but also informal dynamics
underpinned by the several departments that compose it.
